    Dear Senator,


    In December 2013, we had a positive outcome for my parents (Mr Anthony Oscar Xavier and Mrs Claudette Valerie Xavier) Ministerial Intervention application for which we received support from a number of politicians and communities back in 2013.


    Believe it or not, as fate would have it, here I am again at your doorstep again pleading for advocacy for a Health Waiver for my Mum’s visa. Since a successful Ministerial Intervention in November 2013 the following has happened:


    1. 23 December 2013 : An application for Contributory Aged Parent Visa (864) was lodged with Mr. Anthony as the primary applicant.

    2. 15 January 2014 : Bridging Visa granted to my parents. Claudette has been legally living in Melbourne since December 2013.

    3. 26 May 2016 : Mr. Anthony, the primary applicant succumbs to Cancer and passes away.

    4. October 2016 : Mrs. Claudette Xavier who is now suffering from Parkinson’s Syndrome becomes the primary applicant.

    5. 14 February 2017 : Mrs. Claudette Xavier fails the Health requirement for the 864 Visa due to Parkinson’s.

    6. 24 October 2017 : DIBP (Department of Immigration and Border Protection) is willing to consider a Health Waiver but has now requested submission of advocacy in an effort to waive the Health Requirement for Mrs. Xavier.


    Call it bad luck or fate, the family is now expected to go through the entire process (as we did with our Dad) again this time for my Mum. Although it is cruel and to go over the entire process again will be extremely challenging and draining for the family here, the Xavier family respects the Australian government and the immigration law and process, and hence is willing to undertake this journey again as it is in the best interest for my Mum.


    Once again I am pleading for a letter of advocacy for a Health Waiver for my Mum’s Contributory Aged Parent (864) visa application so that she can remain here in Australia. If you are kind enough to provide my family with a letter of support, I will then submit the same to the DIBP through my representative.


    As we did the last time, we seek your compassion and assistance in these exceptional circumstances for my family.

    PS: Some details regarding the family:


    • My parents have 4 children and 6 grandchildren in Australia all of whom are Australian citizens.

    • My dad also has four of his own brothers here in Australia.

    • My dad died of Cancer in May 2016.

    • My Mum is suffering from Parkinson’s and there is no immediate family in India. If her health waiver is not granted she will have to go back to India.

    • My parents application has already been through a rejection in the past. We then had a successful Ministerial intervention and we are now back doing this all over again.
